Sexual Offences Act criminalises consensual sexual activities between children aged between 12 and 16

Criminalising consensual sexual activities between children between the ages of 12 and 16 and making it an offence not to report it to the police was not the proper manner in which to deal with children's sexual behaviour.
The Teddy Bear Clinic for Abused Children and the Centre for Child Law of the Faculty of Law, University of Pretoria are challenging these provisions in court and asked Judge Pierre Rabie to declare them unconstitutional.
The Minister of Justice and the National Director of Public Prosecutions are opposing the application.
